WHAT ARE PRODUCT DESIGNS?

A Registered Design will allow you to claim ownership on any new shape, configuration, pattern or ornamentation.

Design rights can be obtained for new shapes of existing products. For example, the new shape, pattern or ornamentation of a whiskey glass.

Registered Designs could be obtained for example for new shape or appearance of a bicycle helmets; whiskey glasses; vehicle parts, components and fittings; mobile cases; furniture, pool fencing, and so forth.

If the Design drawings that are lodged with IP Australia have the wrong detail, this will leave you with at best a “weak” case and more likely “no” enforcement case ability.

Product Design Registration provides you with an exclusive right (monopoly) to prevent competitors from selling replicas.

It can be extended overseas to protect offshore markets, provided that extension applications are lodged within Convention Treaty time limits.
