Patent a Logo

If you have created a new and creative logo, you are wondering how to patent this newly created intellectual property. You choose to patent a logo option that most big brands do to save their logo from being copied by competitors.

At Australian Patent and Trademark Attorney Services, we offer a patent registration facility to our clients.

However, were you aware that you don’t actually patent a logo – you need to trademark a logo instead?

If approved, a trademark provides legal entitlement to the logo, whereas a patent protects an invention or idea.

A Logo can be trademarked much like a brand, slogan or name. If you have registered your logo, then you are in a position to stop others from misusing your Trademark Logo without your permission. For instance, if you own a logo as a trademark, and the other party is trying to use it without your permission, you ask them to stop using it directly. If they continue to use it, you can take them to the Court of law for infringement.
